The automobile lemon law is designed to protect consumers from irreparable manufacturer’s defects in vehicles that should be covered by a car service contract.
Back in 1972, when purchaser demand for consumer protection started to swell, more than 1 million people were found to have paid for vehicles that had many problems that dealers could not, or would not, repair. Connecticut and California were the first states to implement an automobile lemon law, and other states were quick to follow. Today, with the increased accountability demanded by these laws, the number has dropped to about 100,000 new cases a year.
What Protection Can You Expect Under Lemon Law?
Although every American state has a lemon law, the absolutes of each law vary widely. Specifically, you are a candidate for protection if you have a major problem (or, in some cases, a string of minor problems) that falls under your car service contract. A problem is usually considered severe when it threatens the use, value, or safety of the vehicle. Examples of severe problems that would probably be covered include brake failure, transmission problems, and frequent occasions when the vehicle won’t start. The lemon law in most states will not cover situations like funny noises, loose cup holders, and flaking paint.
The type of vehicle is also important when it comes to protection under the law. In some states, leased vehicles are covered as well as purchased vehicles. Some states exclude automobiles purchased for business purposes or special kinds of vehicles such as RVs and motorcycles. Even used vehicles may be covered if they come with a car service contract.
Some dishonest automotive dealers write a clause in the sales contract that states that no lemon law claims can be made against the vehicle. These requirements, however, are not legally valid and can be ignored – as long as your vehicle has a car warranty and qualifies under the other legal provisions, you will be covered no matter what you signed.
Before the automobile lemon law applies, you must give the manufacturer plenty of opportunity to fix the problem. In most cases, this is defined as a precise number of repair attempts (for example, four attempts to repair the same problem) or a certain amount of time when the vehicle is under repair (for example, four weeks). A life-threatening vehicular defect may require only one attempt at repair before falling under the law.
What Should I Do If I Qualify For The Automobile Lemon Law?
If you feel that you qualify for protection under the lemon law, you must make a claim with the manufacturer within a specific period of time. In most states, the case will then be brought for arbitration with the manufacturer. If you win your case, you will usually receive a replacement vehicle or a refund of your purchase price minus a fee for vehicle use.
Most California manufacturers use the Better Business Bureau Auto line to settle claims; when you contact the manufacturer, they will send you to the Better Business Bureau’s Auto Line. From there, you fill out a claim form and provide any documents that support your case. Your claim gets forwarded to the manufacturer who then has to respond with how they plan to resolve the issue.
When you receive the response, you decide if it is satisfactory. If it is, then your arbitration goes no further, and you receive the benefits that were decided upon. If you are unsatisfied with what the manufacturer proposes, then the Better Business Bureau will start the formal arbitration process. The service is free.
When you are in arbitration, you will be given the opportunity to explain the details of your claim to an impartial judge in the Better Business Bureau offices. It is in your best interest to bring along any documents that might support your claims concerning routine maintenance, vehicle warranty work, and correspondence with the manufacturer over your claim.
Within 40 days of your arbitration hearing, your case will be decided upon. If you are still unhappy with the results, you can take your case to formal court with a lemon law attorney. The manufacturer will be legally bound by the decision of the arbitrator.

Using the words of Bob Dylan, “Times, they are a changing” and this is certainly true when we look at the habits of the new car buyer. Successive governments have failed to curb our excessive fuel demands, indeed, for many years cars just seemed to get bigger and bigger, with fuel consumption figures dropping, sometimes barely hitting double figures. Then came the troubles in the oil producing regions of the world, swiftly followed by the credit crunch and all of a sudden attitudes have changed. Market forces have influenced the new car buyer and as a result, the car manufacturers have moved swiftly to fill the chasm that is opening in the marketplace, the need for comfortable, but fuel efficient new cars. Listed below are ten economical new cars, not in any particular order, or indeed, not even market leaders, what they do have in common though is their ability to travel over fifty miles per gallon on the combined cycle. They may not be the answer to all our problems, buy they are certainly a step in the right direction.
MINI Cooper 1.6 D
The 1.6 diesel MINI Cooper has had the EfficientDynamics treatment by BMW, low rolling resistance tyres, electric power steering, an intelligent alternator control / brake energy regeneration system, an automatic stop-start function and a high precision Direct Injection system are amongst the advances that have been applied to the new diesel Cooper and as a result it achieves a staggering 72.4 miles per gallon on the combined cycle.
Volkswagen Polo Bluemotion
Powered by a 1.4 litre, three cylinder, diesel engine that is fitted with a with a variable-geometry turbocharger that gives maximum assistance at low speeds, the Polo Bluemotion is one of the leaders in its class. Volkswagen have used a few tricks to get the Polo Bluemotion to perform as frugally as it does, the obligatory low-rolling-resistance tyres, lightweight alloy wheels and improved aerodynamics all contribute to the Bluemotion achieving 74.3 miles per gallon on the combined cycle. Exhaust gas recirculation and a particulate filter give the Polo another advantage over most cars in the UK market, Co2 emissions of only 99g/km, resulting in zero road tax. Low cost motoring at its best.
Audi A3 1.9 TDIe
Audi may not be the first manufacturer that comes to mind when it comes to economical cars, but this just goes to show how serious manufacturers are now taking the situation we find ourselves in. The A3 1.9 TDIe is powered by a reworked diesel unit and this combined with aerodynamic tweaks, low-resistance tyres and a ‘recommended gear’ display mean the Audi will travel 62.8 miles for every gallon on the combined cycle. So, if you you’re looking for a car with green credentials, but don’t want to compromise on quality, the A3 1.9 TDIe may tick all the boxes you require.
Citroen C1 1.0i Vibe 3 door
The Citroen C1 could just as easily be substituted with the Peugeot 107 or the Toyota Aygo as they all share the same platforms and the same engines, that said the C1 was chosen for one thing and one thing alone, price. Designed in collaboration between the three manufacturers, all are extremely capable city cars with low road fund bandings and good mpg figures, slight cosmetic differences are really the only things that set the models apart, that and the fact that Citroen run slightly better offers making them the lowest priced model. Powered by a one litre petrol engine the C1 will return 61.8 miles per gallon on the combined cycle and has Co2 emissions of 108 g/km.
New BMW 1 Series 118d EfficientDynamics
Voted World green car of the year in 2008 by 47 journalists from 24 different countries, the BMW 118d EfficientDynamics makes use of energy capture systems, brake energy regeneration, auto stop-start, optimum gear-shift change indicators, electric power steering and lightweight body panels to achieve a quite remarkable 62.8 miles per gallon on the combined cycle. With BMW expecting sales of 700,000 cars a year in Europe that have EfficientDynamics incorporated, the fuel savings are estimated to be in the region of 33 million gallons, quite a substantial saving by anyone’s book
Ford Fiesta ECOnetic
When it comes to economical new cars the Ford Fiesta ECOnetic has to be up there with the best of them. Powered by a specially tuned 1.6 litre diesel engine the Fiesta ECOnetic is the most economical Ford and possibly the most economical car around at the moment. Longer gear ratio’s, a gear change indicator, aerodynamic wheel trims, low rolling resistance tyres, lowered suspension and the fact that it weighs about 40 kgs less than the outgoing Fiesta mean that the ECOnetic will let you drive 76.3 miles on the combined cycle for every gallon of diesel you put in. Ford may be struggling in the US, but with figures like these the Fiesta ECOnetic it sure to prove a big hit in Europe.
Volkswagen Touran 1.9 TDI DPF BlueMotion S 105 5dr
Unfortunately not everybody can utilise a small city car or hatchback, after all some people do have families and this obviously restricts their choice when it comes to buying a new car. For those in that position, Volkswagen has come to the rescue in the form of the Touran Bluemotion. The result, a combined cycle of 65.7 miles per gallon, making the Toyota Prius an ideal car not only for the city, but also for those who choose to commute.
Skoda Fabia 1.4 TDI PD 80 GreenLine
Another offering from the Volkswagen stable to take a trip down to the wind tunnel is the Skoda Fabia Greenline, it may not quite match up to the Polo Bluemotion or the Seat Ibiza Ecomotive, it is however, quite a bit more frugal than the rest of the Fabia range. Achieving 68.9 miles per gallon on the combined cycle, the Greenline should theoretically drive 689 miles on a full tank, put into perspective, that’s seventy miles more than a standard Fabia 1.4 TDI. The Greenline may cost a little more than its siblings, but with petrol and diesel prices as they are, it won’t take very long before you’ve recouped the cash.
New Mazda 2 1.3 TS
Generally, as we get older, we add weight, something that also seems to happen to cars. Redesigns and facelifts always seem to add a few pounds here and there and as a result larger, more powerful engines are required just to achieve the same performance. Not so with the new Mazda 2. When Mazda launched the new 2 model it weighed in an incredible 100 kgs lighter than the model it replaced. It’s safer (five stars from EuroNCAP for adult occupants), has more equipment as standard, yet still manages 52.3 miles per gallon on the combined cycle, quite an achievement really.

The beginning of the Harley-Davidson Motor Company in 1903 was very impressive. The founders, Bill Harley and Arthur Walter Davidson, began at a prototype with a small engine- so weak that it cannot conquer the Milwaukee hills. But, all things must have started from small beginnings. And that was exactly what happened to the Harley-Davidson Motor Company. Schoolboys, as they can be considered, Bill and Arthur may have been born to give contribution to the motor industry.
The concept of the first Harley-Davidson motorcycle was very advanced at that time considering that fact that these two individuals were living in the period where horses were still the main form of transportation and automobiles were still developing. Bill and Arthur lived in an era where motorcycles were still in infant stage. What was more surprising was that, Bill and Arthur were still too young to be founders of a company then.
The prototype may be considered a success but could not produce more power to be efficient in hills. As resourceful as they were, Bill and Arthur made stronger engines that produced more power and speed.
That very same year, Harley-Davidson made its very first sale. Two years later they had made 11 motorcycles. And in 1908, they had made 154.
As the years went by, the company had produced and sold more and more units. Harley-Davidson, which started at a small backyard of a modest home, grew to become a motorcycle empire in a very short span of time.
Innovations after innovations and awards after awards, Harley-Davidson Motors had increased its reputation as the leader in the motorcycle industry.
Harley-Davidson was one of the 2 motor companies that had been commissioned to mass-produce motorcycles for the government to be used for First World War and the Second World War as well.

Creating the Ultimate Vision for Ultimate Success

I’ve been thinking a lot lately about the importance of having a clear, compelling vision to get you past all of life’s challenges and obstacles.
In fact, it prompted me to do a little research about some of our society’s most successful people. For example, did you know that:
· Einstein’s teachers told his parents he would never amount to anything.
· Thomas Edison went broke four times.
· Michael Jordan was cut from his high school basketball team.
· A newspaper editor fired Walt Disney for having no good ideas.
· Steven Spielberg was put into a class for students with learning disabilities.
· Colonel Sanders talked to 1005 people before he could find one person willing to try his recipe. That makes his closing ratio 1005 to one – undeniably the worst I’ve ever seen.
What’s inspiring to me about these highly successful people isn’t just their eventual accomplishments. It’s how they were able to overcome their early failures and go on to achieve greatness.
How did they succeed where so many others fail? Because they each had a grand and sincere vision of what they wanted to accomplish. With a grand vision, there are no such things as permanent failures. There are only temporary setbacks.
Ultimate success comes from having a strong vision. To me, a strong vision is all about setting clear goals. So how can you find your ultimate vision? Try asking yourself some of the following questions:
What do you want to have?
Brainstorm wildly with this one, and don’t hold back. List everything you’ve ever dreamed of having. A new BMW. A trip around the world. Or maybe just a couple of beach houses in Maui. Whatever it is you desire, write it here.
What do you want to experience?
Perhaps a new culture? Parenthood? Or simply the pleasure of never again having to call anyone else “boss”?
What are you willing to give up?
Achieving what you want is about making and managing choices, so ask yourself what you’re willing to give up in order to achieve your goals.
If you want to grow your business by 50% this year, for example, maybe you have to give up your C-rated customers. Maybe you have to give up an hour of sleep a night so you can come into the office and make your sales calls earlier. Or maybe you have to give up working out seven days a week to stay at the office later.
What’s your ideal environment?
What is the ideal environment you like to work and play in? What do you want to do with your time outside of work, or when you go home? Maybe it’s riding motorcycles, learning to cook or writing a screenplay. Maybe it’s having children, or spending time with your family. Or it might just be as simple as going to the beach, reading trashy novels or watching more movies.
If you’re staring outside at a blizzard and feel tears begin to well up in your eyes, maybe your ideal place to work and play is in Florida or the Barbados. On the other hand, if the first snowflake sends you running for your skis, you’re probably already in the right place.
What are you grateful for?
Record where you are today, and compare it to where you were two, three, five or even 10 years ago. Note the differences, celebrate your successes – and resolve to change those things in your life you aren’t happy with.
How long do you expect to live – and when do you want to retire?
What do you plan to do after you retire? What do you want to achieve? And if you end up living ten years longer than you expected to, what will you do with your time then?
For that matter, why wait? Is there anything on your retirement wish list you can start doing right now?

When answering these questions, make sure you spend some uninterrupted thinking time. It could be on an airplane or train, on weekends, in front of the fire or while you’re on vacation. Ideally, you should choose someplace that’s both comfortable and stimulating. But wherever you do your thinking, don’t give the development of your vision short shrift. After all, as U.S. Senator Conrad Burns reminds us:
“In life you are given two ends, one to think with and the other to sit on. Your success in life depends on which end you use the most. Heads you win, tails you lose.”
Once you have the answers to these questions, surround yourself with people who will help you achieve your vision. My father always said – Colleen, if you want to be rich, study from people who are already rich. Similarly, you will more easily achieve your vision if you associate with people who are already living it. Of course, things change over time, so be sure to revisit your answers at least once a year to make sure your vision stays up to date with your lifestyle and what you’ve accomplished. It’s okay for your vision to be dynamic, just so long as what doesn’t change is your commitment to it.
Regardless of any short-term changes that occur in your life, however, you may be surprised to find that your grand vision hardly changes at all. If you answer the questions above as honestly as you can, your vision today will likely be very similar to the vision you create five years from now, because they will both come from your core hopes, dreams and values.

Cars That Make You Turn Green

The rise of the tides, polar bears swimming for their lives and a country with 2 billion people that burns enough dirty coal to blanket the skyline should be enough to make a person at least try to do something good for the environment. But as much as we’d like to ride a bicycle to work, at least here in Southern California, with the most highly traveled freeways in the world, putting the pedal to the asphalt could be as much of a form of suicide as if would be a marathon.
People in Los Angeles have a real love affair with their cars and it’s not just some weekend fling. We LOVE our cars. We love them so much that it’s rare that we’d actually share them with anyone outside the immediate family.
It’s not an unusual sight to see Angelinos riding on the freeway, one person to a car. Oh sure sometimes you can find families in the diamond lane and on weekends you might be lucky to see two or more people in one vehicle going somewhere, but by and large, and mostly during the peak of travel time – rush hour, its one car, one driver.
The solo motorist is a very common animal in this neck of the interstate because to share commute would mean to give up our privacy, our alone time. Since the rush hour driving period can span a good three to fours hours and the average driver has to travel at least 30 to 60 minutes each way to get to work, Californian’s get to use this period of their lives for quiet reflection, catching up with friends, putting on make up, shaving or taking a coffee moment with their favorite half – calf, triple grande latte, no foam, soy Americano.
And if we’re going to spend that much time behind the wheel shouldn’t we at least be comfortable? Of course the real question is – Can we be GREEN as well?
At one time, not too long ago, Hybrid cars were pretty much looked upon as something for the future along with jet packs and talking wristwatches. But since the dawn of the 21st century a plethora of Hybrid and Green vehicles have begun to be produced and on a mass production scale.
No longer mere electric autos that only went as fast as your grandmother’s Rascal with a battery the size of a work bench and a life span of a gnat, today we usher in a whole new breed of environmentally friendly cars that actually look, act, feel and drive like – cars.
And they come in all sizes.
If you’re a big person or just like your SUV but don’t like the way Prius owners sneer at you when you pass, you’re in luck. Manufacturers like Toyota, GM, Chevy, Saturn and more have taken your beloved behemoth and turned it green. The Saturn Aura Green Line SUV is one of their newest gas-electric hybrids to step up to the plate without having to eat the whole dinner. The new Vue Green Line two Mode puts together the output of the Saturn’s 3.6 liter, direct injection variable valve timing V-6 with two active-cooled 55 kW electric motors. This combination gives you excellent performance without having to sacrifice leg room or cargo space just because you want to get better gas mileage and save the planet.
General Motors is definitely jumping the shark and will be offering 16 new Hybrid models over the next four years. The same hybrid evolutionary platforms will be seen in other car models such as the Chevy Silverado and the GMC Sierra. Finally full sized trucks that can have descent gas mileage, much lower emissions and be part of the green revolution. It’s enough to make a red neck scratch his head and wonder what’s going on in the world.
Now if you like the idea of smaller cars and want to get away from gas altogether you may want to check out something like the “neighborhood” type of all electric vehicles, like the GEM Peapod Electric Car.
Yes, the Peapod. This little car from Chrysler’s GEM, ENVI division seems more like an iPod accessory than a form of transport, yet the Peapod is a sleek ultramodern urban auto whose name comes from its teardrop shape stuck on wheels.
Using the oval form provides maximum interior space with grand viewing capabilities through over sized tinted glass, including an over head roof panel. With seating for four, the 102 inch wheelbase has an overall length of 143.6 inches. It’s just 56.5 inches wide but 70.5 inches tall. This makes the Peapod two inches shorter than the Mini Cooper but with a longer wheelbase.
Truly a car for the city, Peapod drivers have a 32 feet curb to curb turning circle with the entire vehicle weighing not much more than 1,290 pounds. The rated payload capacity is just 910 pounds which is plenty for four adults in a comfortable setting.
The downside is the Peapod isn’t going to take you outside the city or anywhere that has a speed limit above 35 mph, but it can get you as far as 30 miles on a full charge. After that you’ll need to plug her into a standard 110 – volt outlet and juice her up for about six to eight hours.
